STEVE’S MUSIC STORE NOTES
PROGRAM® TERMS AND CONDITIONS
PARTICIPATING STORES
The Steve’s Music Store Notes Program (the "Program") is available through participating Steve’s Music Stores.
MEMBERSHIP ENROLLMENT
2. To participate in the Program a customer must become a member of the Program. Membership is absolutely free and no initial purchase is required. Upon completion, the member will receive his/her own Steve’s Music Store Notes Card.
3. Only one Steve’s Music Store Notes Card membership is available per customer.
4. The Steve’s Music Store Notes Card is not a credit card. The Steve’s Music Store Notes Card is the property of Steve’s Music Store Inc. and it may be revoked at any time by Steve’s Music Store in its sole discretion.
5. Each Steve’s Music Store Notes Member will be issued a Steve’s Music Store Notes Card that has a unique number ascribed to it and registered in the Member’s name.
6. Steve’s Music Store Notes Members should advise Steve’s Music Store immediately of any changes of personal information including name, address, telephone numbers and email by contacting the Customer Service Centre.
7. Steve’s Music Store reserves the right to refuse issuance of a Steve’s Music Store Notes Card to any customer who does not follow the prescribed enrolment procedures

8. Customers participating in the Program must present their personal valid Steve’s Music Store Notes Card to collect and earn rewards. Any unauthorized reproduction of the Steve’s Music Store Notes Card may lead to legal prosecution and forfeiture of all Steve’s Music Store Notes and Membership in the Program.
9. Steve’s Music Store Notes Membership is only available to individuals.
COLLECTION OF STEVE’S MUSIC STORE NOTES
10. To collect Steve’s Music Store Notes, following enrolment a Steve’s Music Store Notes member must make purchases at participating stores using their personal valid Steve’s Music Store Notes Card. The member’s personal Steve’s Music Store Notes Card must be presented to the salesperson at a participating store before the purchase transaction is completed.
11. Steve’s Music Store Notes will be awarded at the rate posted on individual products sold by Steve’s Music Stores.
12. Steve’s Music Store Notes will be issued only for purchases made through participating stores.
13. Steve’s Music Store reserves the right to add or delete items eligible for Steve’s Music Store Notes at any time.
14. All Steve’s Music Store Notes are shown on the cash register receipt for each purchase when a Steve’s Music Store Notes Card is presented before the completion of the purchase transaction. In the event that Steve’s Music Store Notes do not appear on a receipt due to a technical failure, they will be updated on the cash register receipt at a later purchase transaction date. Steve’s Music Store Notes Members may also inquire about their balance through the Customer Service Centre
15. Returns and/or exchanges will be honoured only if the original cash register receipt is presented at the time of the return and /or exchange. Steve’s Music Store Notes will be deducted automatically from the Steve’s Music Store Notes Member’s card number that was used for the original purchase (whether or not the Steve’s Music Store Notes Card is presented at the time of return and /or exchange). Upon the return and /or exchange of purchases earned through the redemption of Steve’s Music Store Notes, all redeemed Steve’s Music Store Notes will be forfeited.
16. All Steve’s Music Store Notes totals, as shown on the cash register receipts, will be deemed correct unless otherwise substantiated by the Member by bringing forward evidence satisfactory to Steve’s Music Store in its sole discretion. Discrepancies must be addressed to the Customer Service Centre within one (1) week of the date on which the discrepancy occurred.
17. Steve’s Music Store Notes are not transferable from one Steve’s Music Store Notes Member to another
18. Steve’s Music Store Notes are reduced to zero upon closure of a Steve’s Music Store Notes Membership.
19. Upon the death of a Steve’s Music Store Notes Member, the Member’s account will be closed and any Steve’s Music Store Notes in the account will be forfeited. Steve’s Music Store Notes are not divisible in the case of divorce.
20. Should any Steve’s Music Store Notes Member not acquire Steve’s Music Store Notes for six (6) consecutive calendar months, the Membership will be deemed to be inactive and all accumulated Steve’s Music Store Notes will be forfeited. At that time the Steve’s Music Store Notes balance may be reduced to zero at Steve’s Music Store’s discretion.
REDEMPTION OF
21. Steve’s Music Store Notes may be redeemed for Products.
22. From time to time, special promotions may be run and one or more redemption levels may temporarily be altered and/or suspended or new redemption levels added.
23. In accordance with federal and provincial tax legislation, GST, PST and any other applicable taxes are calculated and payable by the Steve’s Music Store Notes Member on the full amount of the purchase price before any reduction for redeemed rewards.
24. A Member’s Steve’s Music Store Notes balance will be reduced by the number of Notes required to obtain the desired Point redemption level. Unredeemed Steve’s Music Store Notes plus any Steve’s Music Store Notes earned in the current transaction will remain in the Member’s Steve’s Music Store Notes account and can be applied to a subsequent transaction.
25. Steve’s Music Store Notes can only be redeemed if the required Point redemption level is acquired prior to the redemption transaction.
26. When redeeming Steve’s Music Store Notes, Steve’s Music Store will automatically select the maximum eligible Steve’s Music Store Notes available. Alternatively, the Steve’s Music Store Notes Member may select a partial redemption level by informing the salesperson prior to redemption of Steve’s Music Store Notes. In either case, the Steve’s Music Store Notes Member’s account under his/her Steve’s Music Store Notes Card number must have the appropriate number of Steve’s Music Store Notes.
27. Steve’s Music Store Notes may not be collected or redeemed by any person other than the Steve’s Music Store Notes Member. Steve’s Music Store Notes Members may be required to provide proof of identity when redeeming Steve’s Music Store Notes to protect the integrity of the Member’s balance.
28. In case of a lost Steve’s Music Store Notes Card, upon presentation of proper identification a new Member’s number will be provided to the Member by the Customer Service Centre or at any participating Steve’s Music Store The accumulated unredeemed Steve’s Music Store Notes balance shall remain intact. If a lost Steve’s Music Store Notes card is found and used by any other person, all Steve’s Music Store Notes relating to purchases made by such other person will be credited to the Steve’s Music Store Notes Member’s account. Steve’s Music Store assumes no liability or responsibility for Steve’s Music Store Notes redeemed by any person(s) prior to the notification to the Customer Service Centre that the Steve’s Music Store Notes Card is lost. Any Steve’s Music Store Notes redeemed prior to notification shall be at the Steve’s Music Store Notes Member’s risk.
29. Steve’s Music Store will not be liable or responsible in any manner for any tax consequences which may flow from any participation in the Steve’s Music Store Notes Program by any non-Canadian resident, and where permitted by Steve’s Music Store, by any corporation, business, charity, partnership or enterprise.
30. From time to time Steve’s Music Store may advertise exclusive offers to Steve’s Music Store Notes Members with respect to which they may redeem Steve’s Music Store Notes for products
31. Steve’s Music Store Notes have no cash value and are not exchangeable for cash. Steve’s Music Store Notes cannot be sold or purchased. Steve’s Music Store Notes are void if sold for cash or any other consideration.
32. Steve’s Music Store shall maintain the privacy, security and integrity of all personal information collected from Steve’s Music Store Notes Members, such as, but not restricted to: name, address, telephone numbers, date of birth and purchasing information. This information will be used to credit the correct Membership number account, to communicate with the Steve’s Music Store Notes Member, to better understand the Steve’s Music Store Notes Member’s shopping and information needs and to offer the Steve’s Music Store Notes Member relevant information, products, services and rewards to meet those needs.
33. On occasion Steve’s Music Store may collect additional personal information from Steve’s Music Store Notes Members on a voluntary basis though questionnaires or other methods. The Steve’s Music Store Notes Membership status of any Member who does not wish to participate will not be affected.
34. Steve’s Music Store will not give, rent or sell its Steve’s Music Store Notes Member lists to any organization or individual. Steve’s Music Store will allow limited and secured access to customer information by authorized entities under its strict supervision solely for the purposes of assisting Steve’s Music Store in processing customer information. The Member acknowledges that personal information may be accessed by a third party for the purpose of processing that information on Steve’s Music Store’s behalf under the requirement to maintain such information secure and confidential and shall not retain such information.
35. Steve’s Music Store Notes Members have the right to know what information is held in their Steve’s Music Store Notes Member file and the right to question and request correction of any erroneous information. There will be no charge for a Member to gain access to his/her file. To access a Member’s file, a written request should be sent to: Steve’s Music Store Notes Program, 123 Labrosse, Pointe Claire, Qc H9R 1A3. All written requests will be responded to within a reasonable time frame. If for any reason access to an account is not granted, the Member will be provided with a written reason. Steve’s Music Store will make all necessary and reasonable corrections to its Steve’s Music Store Notes Member files with all due diligence.
36. Steve’s Music Store Notes Member information is stored in Steve’s Music Store’s confidential databases located in Montreal, Quebec Access to this information will be restricted only to authorized personnel of Steve’s Music Store inc.
37. On occasion, Steve’s Music Store may communicate special offers, information and services to Steve’s Music Store Notes Members.
38. Steve’s Music Store hereby agrees to respect and observe the provisions set forth in An Act Respecting the Protection of Personal Information in the Private Sector (Quebec) (the "Act") and any other applicable legislation. To the extent there is additional protection afforded to the Steve’s Music Store Notes Member pursuant to the Act or any other applicable legislation, and same is not set forth herein, Steve’s Music Store agrees to take such measures to give full effect to such additional protection.
GENERAL INFORMATION
39. Steve’s Music Store reserves the right to extend the Program beyond the Termination Date, or terminate the Program at any time prior to the Termination Date, by providing 30 days notice in Steve’s Music Store flyers and notices posted in participating Steve’s Music Store stores. If events beyond Steve’s Music Store’s control materially affect Steve’s Music Store’s ability to operate the Steve’s Music Store Notes Program, the Program may be suspended or terminated without notice.
40. Steve’s Music Store may restrict, suspend or otherwise alter any aspect of the Steve’s Music Store Notes Program, without notice. Any material changes to these Terms and Conditions will be posted in participating stores and a copy of the Terms and Conditions will be made available upon request.
41. The Steve’s Music Store Notes Member’s signature on the Steve’s Music Store Notes Card and first time usage of a Steve’s Music Store Notes Card constitutes agreement by the Steve’s Music Store Notes Member to all the Terms and Conditions of the Steve’s Music Store Notes Program.
42. Any abuse by a Member of the Steve’s Music Store Notes Program’s privileges, any failure by a Member to follow the Program’s rules, regulations, Term and Conditions, or any misrepresentation by a Member may, at Steve’s Music Store’s sole discretion, subject the Member to expulsion from the Program, including forfeiture of all accumulated Steve’s Music Store Notes.
43. Upon suspension or termination of the Program for any reason whatsoever, Steve’s Music Store will have no liability therefore to any Member and is automatically released from all claims by Steve’s Music Store Notes Members in respect of such suspension, termination, forfeiture of , redemption of or otherwise in respect of such suspension, termination, forfeiture of , redemption of or otherwise in respect of such suspension or termination.
44. Every effort has been made to ensure that the information herein is correct. Steve’s Music Store is not responsible for any errors or omissions.
45. Any waiver by Steve’s Music Store of the strict observance, performance or compliance by a Member with any of the Terms and Conditions contained herein, either expressly granted or by course of conduct, shall be effective only in the specific instance and shall not be deemed to be a waiver of any rights or remedies of Steve’s Music Store as a result of any other failure to observe, perform or comply with the Terms and Conditions. No delay or omission by Steve’s Music Store in exercising any right or remedy hereunder shall operate as waiver thereof or of any other right or remedy.
46. By redeeming Steve’s Music Store Notes for rewards the Steve’s Music Store Notes Member releases Steve’s Music from any and all liability and claims regarding the redemption and use of the reward and any loss or damage caused by goods and services supplied as a reward.
47. Any reference herein to Steve’s Music Store refers to Steve’s Music Store Inc.
48. No right shall be exercised by Steve’s Music Store in an excessive and unreasonable manner, or which is contrary to the requirements of good faith.
49. The Member agrees that this document may be drawn up in the English language. Le Membre déclare qu’il a exigé que ce document soit rédigé en langue anglaise.
